FBR Proposes 10% Tax Credit on Digital Integration Investments in Pakistan

The Federal Board of Revenue (FBR) has proposed new rules governing tax credits for businesses investing in electronic systems integrated with its computerized systems. The proposal aims to encourage digital compliance, improve real-time reporting and support businesses required to connect their systems with the FBR.

Under the proposed framework, eligible taxpayers may claim a tax credit equal to 10% of qualifying digital integration investment, subject to prescribed conditions and restrictions.

What Is the Proposed FBR Digital Integration Tax Credit?

The proposed rules introduce a framework under Section 64D of the Income Tax Ordinance, 2001, for claiming tax credits on qualifying electronic resources used for integration with the FBR’s computerized systems.

Eligible investments may include equipment, hardware, software and other electronic components used exclusively for required integration, such as real-time production monitoring and recording or reporting sales and receipts.

Key Conditions for Claiming the Tax Credit

Under the proposed rules, taxpayers would generally need to meet the following conditions:

  • Mandatory integration: The taxpayer must be legally required to integrate with the FBR’s computerized system.
  • Eligible investment: Qualifying equipment, hardware, software or electronic components must be purchased, installed or implemented for the required integration.
  • Exclusive use: The electronic resources must be directly and exclusively used for the relevant integration purpose.
  • Successful integration: The resources must be integrated and configured with the FBR system within the relevant tax year.
  • Supporting evidence: Taxpayers must maintain the required activation, commissioning or configuration records to substantiate their claim.

Routine operation and maintenance expenses are not intended to qualify as eligible investment under the proposed framework.

How Much Tax Credit Can Businesses Claim?

The proposed tax credit is 10% of the qualifying investment amount, subject to the applicable legal conditions.

For example, if a business makes a qualifying investment of Rs. 1,000,000 in eligible digital integration resources, the proposed credit would be Rs. 100,000.

The actual amount claimable will depend on the final rules, the nature of the investment and the taxpayer’s eligibility. The proposed credit is intended to be available against normal income tax payable, and restrictions may apply to taxpayers liable under a minimum tax regime.

What Should Businesses Do Now?

Businesses required to integrate with the FBR should review their digital infrastructure and maintain proper records of eligible investments. They should retain purchase invoices, installation costs, configuration details and evidence confirming successful integration.

Taxpayers should also verify the applicable legislation and final rules before claiming any credit, as the proposal may be subject to changes.
